If a tenant’s apartment has conditions or violations of record necessitating repair, a tenant may commence a proceeding against the owner or landlord to force the owner or landlord to make repairs and correct violations of record.  This is referred to as an “HP proceeding.”  Levy Tolman LLP routinely defends owners and landlords in HP Proceedings. We also ensure that our clients only expend resources on conditions that are required to be fixed in accordance with the law. We help owners differentiate between repairs that are mandated by the Housing Maintenance Code and conditions that are de minimus or merely cosmetic.
